Supplementary Recruiting Privacy Policy

1. What is this Privacy Policy about?

This Privacy Policy describes how and for what purposes companies of the Migros Group process your personal data in the context of recruiting. Recruiting in this sense particularly includes the following activities: 

  • receiving and processing applications submitted via the Migros Arbeitswelt platform; 
  • receiving and processing applications submitted directly to the company that posted the job advertisement; 
  • Talent Relationship Management in connection with the Migros Group's talent pool; 
  • and other activities in connection with recruitment. 

The processing of personal data is primarily subject to the privacy policy of the company to which you are applying. Data processing within the scope of the Migros Arbeitswelt platform and Talent Relationship Management is initially governed by the General Privacy Policy of the Migros Group, which you can view here: privacy.migros.ch. This Supplementary Recruiting Privacy Policy contains further information on data processing in connection with recruiting. It applies in addition to the respective applicable general privacy policy. 

This Privacy Policy is applicable both to applications submitted directly by applicants and to applications we receive from recruitment agencies. Recruitment agencies are obliged to inform applicants about this Privacy Policy.  

2. Who is responsible for data processing?

In general, a company of the Migros Group («we» or «us») is responsible for data processing under data protection law in accordance with this Privacy Policy. 

As a rule, the Migros Group company responsible is the one that advertised the position for which you are applying, i.e. the potential employer. For data processing in connection with the Migros Arbeitswelt platform and Talent Relationship Management, the Federation of Migros Cooperatives, Limmatstrasse 152, 8005 Zurich (CHE-105.829.940) is generally responsible. 

In certain cases, another company in the Migros Group may also be responsible for data processing, either solely or jointly with us. Information on the companies belonging to the Migros Group can be found in  section 2 of the General Privacy Policy of the Migros Group.

3. Which personal data do we process?

In connection with recruiting, we process in particular the following personal data: 

  • master and contact data provided in application forms or other application documents (usually salutation, title, name and first name, date of birth, email address, postal address); 
  • all other information contained in your application documents regarding your background, qualifications, motivation, job interests and preferences, as well as other information about yourself (e.g. in your cover letter, CV, references, certificates, diplomas, etc.); 
  • additional information that may be requested or provided in application forms, such as information about profiles you maintain in job-related social networks (e.g. Xing, LinkedIn), or information about how you became aware of the job posting; 
  • information obtained during the application process (e.g. from interviews) or from discussions with HR specialists; 
  • where applicable, information from third-party sources (e.g. information from official registers, information from recruitment agencies, references); 
  • image and audio recordings, as we may conduct telephone or video interviews depending on the job profile and may record them if necessary; 
  • information from your previous employment relationship if you are already employed at a Migros Group company; 
  • personal data of contact persons submitting the application, and personal data of third parties where you provide it to us; 
  • technical data (e.g. log data, information about the time of access to the platform, duration of the visit and the pages accessed, and information about the end device used) when you visit the Migros Arbeitswelt platform. 

All this information may also include sensitive personal data if you disclose it to us, e.g. health data. We may also process other master data, contract data, communication data, behavioral and transaction data, preference data, technical data, and other categories of personal data. More information on this can be found in the respective applicable general privacy policy of the advertising or responsible company. Additional information on how we handle sensitive personal data can also be found in the respective applicable general privacy policy. 

You are not obliged to provide us with personal data. However, it is not possible to include you in the talent pool or process an application without collecting and processing personal data.  

4. For what purposes do we process personal data?

In connection with recruiting, we process personal data in particular for the following purposes: 

  • to review and pre-select applications; 
  • to generate leads and expand the talent pool; 
  • to match your profile with vacant positions within the Migros Group; 
  • to send targeted information about job vacancies or to send company information; 
  • to evaluate and optimize the Migros Arbeitswelt platform, our Talent Relationship Management and the recruitment process, e.g. through surveys or statistical evaluations; 
  • to coordinate with HR specialists within the Migros Group; 
  • to contact applicants or potential talents regarding relevant vacancies; 
  • to conduct application procedures or aptitude tests; 
  • to prepare for and, if necessary, conclude an employment contract; 
  • with your consent, we may also process personal data to contact you regarding other vacant positions. 

We may also process personal data for other purposes in connection with communication, contract processing, information and marketing, market research, security and prevention, compliance with legal requirements, protection of rights, and internal group administration and support. More information on this can be found in the respective applicable general privacy policy of the hiring or responsible company. 

If we are able to consider you for the position you applied for, we will subsequently process your personal data for purposes related to the employment relationship. A specific privacy policy for employees may apply in this context. 

5. For how long do we process personal data?

We generally store your personal data for as long as it is necessary to carry out the specific application process and, if necessary, to comply with legal requirements or if we have a legitimate interest in storing it, e.g. for documentation purposes and to safeguard and defend legal claims. If no employment contract is concluded with you, your personal data will generally be deleted or anonymized within six months of the end of the application process. With your consent, we may process your personal data for up to twelve months if we are currently unable to offer you a position and you wish to keep your application pending for future job openings. If your personal data is included in the talent pool, we will store your personal data for a period of 12 months from the date of your previous consent. Before this period expires, you will be contacted to confirm your consent to remain in the talent pool. You may withdraw your consent at any time. 

6. What else is there to be aware of?

In principle, only those persons who are involved in filling the position have access to your personal data, in particular HR specialists and potential supervisors of the hiring or responsible company, as well as selected key personnel from the department where the position is located, if applicable. These persons are subject to a duty of confidentiality and are aware of data protection and data security matters. 

Under certain circumstances – particularly in connection with our talent pool – we may make your personal data available to other Migros Group companies to assess how well your profile matches vacant positions. If your profile matches a vacant position, you will be contacted by the responsible HR specialists or a potential supervisor of the responsible company and asked whether you would like to participate in the application process. In addition, we may share your data with other Migros Group companies for purposes of group-internal administration and statistical analysis on a non-personal basis. 

Beyond this, your personal data will generally only be shared with other recipients with your consent (e.g. for obtaining references), or to the extent necessary to comply with legal requirements or to safeguard or defend legal claims. 

We may also make certain decisions automatically. «Automated individual decision-making» refers to decisions that are made on a fully automated basis in individual cases, meaning with no relevant human influence, and that have negative legal effects or other similar adverse effects. For example, we may decide by automated means not to pursue an application due to an obvious lack of qualifications. In such cases, we will inform you separately.

  • the sources from which the personal data we process originate; 
  • which legitimate interests we have with respect to data processing and on which other legal grounds our processing is based; 
  • how we use personal data within the Migros Group and under what circumstances we may disclose personal data to companies outside the Migros Group; 
  • how we transfer personal data abroad and which precautions we take to ensure adequate data protection; 
  • how and why we use profiling and whether we make significant decisions entirely by automated means; 
  • which measures we take to ensure the security of personal data in an appropriate manner; 
  • how long we generally process and store personal data; 
  • how we use cookies and similar technologies when our websites and mobile apps are visited; 
  • the rights you hold in connection with the processing of your personal data and how you can exercise these rights; 
  • how you can contact the data protection officer of the Migros Group or their representative in the European Union or European Economic Area. 

8. Changes to this Privacy Policy

This Supplementary Recruiting Privacy Policy may be updated over time, especially if we change our data processing activities or if new legal provisions become applicable. We will actively inform individuals whose contact details are registered with us of any material changes, provided that we can do this without disproportionate effort. In general, the version of the Privacy Policy in effect at the time at which the data processing activity in question commences is applicable.
